LexisNexis Litigation Update: BAPCPA's Impact on Consumer Bankruptcy Law

The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 became law on April 20, 2005, and contains the most significant changes to bankruptcy law in 25 years and amends nearly all Bankruptcy Code provisions. Under BAPCPA, it is more difficult for consumers to have their debts discharged in a Chapter 7 bankruptcy: under some circumstances, a person’s only alternative is to file under Chapter 13, which requires a repayment plan over a period of years, and debtors now have to pay for pre-petition credit counseling. Mealey’s Preemption Report 2006: Pharmaceutical Drugs

The FDA’s decision to include language detailing its stance on preemption in the preamble of a Jan. 18 rule concerning the presentation of information in prescription drug labeling has had a remarkable impact on the litigation of pharmaceutical drug claims. Contrary to the belief of plaintiffs and findings of several federal judges that FDA regulations are “minimum standards,” the agency said in its rule that its requirements for prescription drug labels are both a “ceiling” and “a floor” and that state law failure-to-warn claims are preempted because they conflict with federal regulations. This report will include motions and rulings filed in the wake of the agency’s statements as well as contrasting commentaries from both sides of the bar. Mealey’s Litigation Summary: Heart Devices

In the space of a few months in early 2005, Medtronic announced it had found problems with batteries that power one of its implantable cardiodefibrillator (ICD) heart device and Guidant confirmed that it knew of defects in some models of its ICDs and its cardiac resynchronization therapy defibrillators (CRT-Ds), another heart device. With a few deaths attributed to failed devices and many more replacement surgeries taking place, plaintiff attorneys have filed scores of class action and individual lawsuits seeking compensation for injuries and medical monitoring. Petitions have been filed to centralize federal lawsuits for both Medtronic and Guidant devices. Mealey’s Preemption Report: Drugs & Medical Devices

Since the U.S. Supreme Court decided in its 1996 Medtronic v. Lohr decision that some product liability claims involving some medical devices are preempted by federal law, state and federal courts have produced dozens of rulings interpreting what one judge called a “confused ruling.” Today, all U.S. Circuit Courts of Appeals have weighed in, creating a conflict that the Supreme Court has, to date, declined to resolve. In the past few years, drug manufacturers have argued, based on Lohr and support from the federal government, that product liability claims involving drugs are also preempted. Mealey’s Litigation Update: Dura Pharmaceutics v. Broudo – The Aftermath

In April 2005, the U.S. Supreme Court in Dura Pharmaceuticals, Inc., et al. v. Broudo, et al. set forth the requirements for adequately pleading loss causation in a securities fraud case. The court held that an investor must prove a causal link between the alleged fraud and the investor’s economic loss. Following Dura, lower courts are applying that standard. Federal district courts and circuit courts of appeal are beginning to clarify the allegations necessary to survive a motion to dismiss.
