8th Circuit: Court Failed To Consider Congressional Policy In Gaming Dispute

LOUIS — A panel of the Eighth Circuit U.S. Court of Appeals on May 8 held that a district court abused its discretion by failing to consider congressional policy underlying the Indian Gaming Regulatory Act (IGRA) and its intent that tribes be the primary beneficiaries of Indian gaming when it issued an opinion denying relief to the Fond du Lac Band of Lake Superior Chippewa in its suit seeking relief from paying the City of Duluth rent for operating the casino (City of Duluth v. Fond Du Lac, No. 13-3408, 8th Cir.; 2015 U.S. App. LEXIS 7611)....
