Catholic School Teacher Seeks Supreme Court Review Of Fair Representation Claim

Mealey's (February 7, 2023, 2:08 PM EST) -- WASHINGTON, D.C. — A parochial-school teacher found by the Second Circuit U.S. Court of Appeals in a matter of first impression to have failed to successfully bring a duty of fair representation claim against the union representing him under the guidance in NLRB v. Catholic Bishop of Chicago filed a pro se petition in the U.S. Supreme Court asking the justices to decide “[w]hether the Second Circuit contravened the Fourteenth Amendment Equal Protection clause by holding that . . . the federal government cannot certify labor organizations that represent teachers in church-operated schools, but New York State can,” contravened Supreme Court precent by holding that the teacher was precluded from bringing his claim against the union and whether the ruling in Catholic Bishop “means that unions for teachers employed by church-operated schools should not exist at all.”...
