Judge:  Asbestos Settlement Fraud Claim Not Limited To Withheld Discovery

Mealey's ( August 17, 2020, 12:43 PM EDT) -- HONOLULU — A Hawaii federal judge on Aug. 13 said that in a case where settling asbestos  plaintiffs claim that the defendant withheld discovery to induce a lower settlement, the court must consider all "known or foreseeable facts" that existed at the time of the settlements and not just the undisclosed facts (Terry N. Agena, et al. v. Cleaver-Brooks, Inc., et al., No. 19-89, D. Hawaii, 2020 U.S. Dist. LEXIS 146122)....
