Judge Holds Paraquat MDL In Abeyance Pending Supreme Court Ruling In Durnell

( March 16, 2026, 9:30 AM EDT) -- BENTON, Ill. — A federal judge in Illinois has issued an order granting the plaintiffs’ request to hold in abeyance the defendants’ motion for partial summary judgment on state failure-to-warn claims in the multidistrict litigation for liability from injuries connected to the pesticide paraquat. In the order, which was posted as a note to the docket, the judge said the U.S. Supreme Court’s pending decision in Monsanto v. Durnell, which addresses whether failure-to-warn claims are preempted by the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) with regard to litigation involving the herbicide Roundup, “could have consequences for the viability of Plaintiffs' failure to warn claims” in the MDL....
